1. General information

1.1 These general conditions for the marketing of prepaid service credits ("General Conditions") apply to the relationship between you and Image in Network SAS when purchasing prepaid service credits.

1.2 Image in Network SAS is a company incorporated under French law, registered in the Paris Trade and Companies Register number 792 662 637 and whose registered office is at 3 bis rue René Cassin 91310 Massy, ​​represented by Mr. Simon FEUERMANN , President of the company.

1.3 The prepaid service credit (“Credit”) is understood to be any instrument, physical or electronic, which allows its holder (the “Credit Holder”) to benefit from the range of services offered by the Service Provider. during the period indicated on the Coupon (“Usage Period”).

1.4 The Service Provider's offer is understood as the services described in the appendix to these GTC and to be provided by the latter to the Credit Holder ("Seller's service offer").

1.5 The last revision of these General Conditions was carried out on July 1, 2020. Image in Network reserves the right to revise these General Conditions at any time. Modified versions of the General Conditions will be posted online. In any case, you will only be bound by the version of the General Conditions to which you have expressly consented at the time of purchasing service credits.

2. Purchase of service credits

2.1 You must be an individual, at least 18 years old, or a company duly registered in the commercial register to purchase service credits. Before making a purchase, you must register and open an account with Image in Network SAS.

3. Principles of service credit

3.1 A Service Credit is equivalent to one hour of service.

3.2 One hour of service started, paid in service credit, is due in full.

3.3 Travel costs on site are invoiced by one or more Service Credits depending on the geographical location.

3.4 A service credit is prepaid in full on the date of the order.

3.5 The Customer may acquire volumes of service credits according to the list defined and available in the appendix.

3.6 A service credit or a volume of service credits are valid for twelve months from the date of purchase.

4. Use of a Coupon

4.1 Unless expressly stated otherwise: (a) A Service Credit can only be used once; (b) A credit can be used for all types of services offered by the Service Provider. (c) the Service Credit can only be used by the Service Provider; (d) the Service Credit is only valid for one natural or legal person; and (e) you must follow the instructions for use associated with the Service Credit. (f) Service Credits cannot be transferred to a third party or a third party company.

4.2 If you do not use the Service Credit within the Usage Period, it automatically expires. You can no longer use it and cannot claim any reimbursement or compensation.

5. Withdrawal

5.1 In accordance with Article L. 121-21-8 of the Consumer Code, you will not be able to exercise your right of withdrawal for Service Credits.

6. Image in Network SAS obligations and liability

6.1 The Service Provider undertakes to:

6.1.1 perform its obligations in accordance with these General Conditions with a reasonable degree of diligence and skill;

6.1.2 not to contravene the requirements of fairness and professional diligence in what it undertakes.

6.2 In the performance of its obligations, the Service Provider is always liable: (a) for gross negligence or willful misconduct which indicates gross negligence on its part; (b) in the event of fraud or any fraudulent representation thereof; or (c) if this is provided for by legislative and public policy provisions of French law.

6.3 Excluding what is stated in section 5.2 above, the Service Provider is not liable for indirect damages related to the performance of its obligations.

6.4 The Service Provider is not responsible for the violation of any obligation arising from these General Conditions in the event that Image in Network is prevented or hindered in the performance of its obligations due to unforeseeable and insurmountable events caused by a third party beyond its control and thus constituting a case of force majeure.

6.5 Notwithstanding the foregoing, all public policy provisions of French law are intended to apply to you.

7 Competent court

7.1 In the event of a dispute, express jurisdiction is attributed to the commercial court of EVRY, notwithstanding multiple defendants or warranty claims, even for emergency proceedings or for conservatory proceedings, in summary proceedings or by request. < / p>
